Liability ?

What do people do for liability insurance ?. The unthinkable may happen - injurous collision. Does anyone have advice ?.
Also, what do people do when someone else collides with you ?. My daughter was hit by one of a group of teenagers bombing the hill, I admonished the jerk, but only later found out we needed to get a cat scan to rule out concussion. I realised then, I should have got some ID from the culprit, in order to claim the my copayments back.

Honestly - don't know where you live, but contact a good attorney, and for a small fee he/she will be very happy to let you know.

Talk to your insurance agent and ask about getting a personal Liability umbrella added to your homeowner's or renter's policy. It's not that expensive.

A few years ago I collided with an elderly man on skis. I was riding down the side of a wide trail and he was skiing across the fall line. I yelled and screamed that I was coming up behind him but he just kept coming. We collided side by side – I did not barrel him over and we did not hit at a high rate of speed, I didn’t even fall, but he was quite shaken up, maybe a dislocated shoulder.

I filled out an accident report and a few months later got a letter from his attorney informing me that he intended to sue and that I should contact my homeowners insurance co. About a year and half later my insurance company informed me that they had settled with him for $25,000!!!!!

Thanks for the info. I guess this is something people don't like to talk about - out of sight out of mind maybe ?. but a little knowledge may be useful if the unexpected happens.

the idea of a civil case over getting hit by a someone while skiing or what ever is so disgusting
has it ever occured to some people that snow sports are high risk sports
I have been working at a ski areas for seven or so years I see people get hurt all the time I really do have to say most collisions are avoidable but that does not mean you should be able to get that persons pay check
I can see maybe if someone intended to hit you but thats pretty rare
Americans are way too sew happy

my intent is not to anger anybody but I really think this stuff gets out of hand

I totally agree with bob dea.

You're at a ski resort, doing a dangerious activity with other people of varried skill and experience. I think you just have to accept that you or your family may be injured, and it may be some idiots fault you get hurt. That's sad, but it's also part of the package. If someone does something that is clearly out of the bounds of common sense, like say, sliding while abusing substance or intentionally crashing someone out of skiier rage or something... then IMHO gripes are legitimate. But other than that, I think you just have to accept that you are chosing to place yourself in a dangerous situation. Just like auto racing, or many other sports.

Generally the consept of acceptance of the risk applies to all sport participants. If you run into someone, generally it is assumed that you accepted that risk. There have been cases where participants were drunk and ran into someone and the drunk was found liable. You are not expected to accept the risk of people being on the slopes drunk. I have also heard of liability being imposed for extreme speed or other extremely negligent behavior.

Yes, skiers and snowboarders have to accept the risk that somebody who is breaking the rules may crash into them, causing personal injury and damaging expensive property.

Just like the way you accept that risk when driving. Driving is a dangerous activity, and everybody accepts the risks, and nobody sues.

In America you have to sue. It's a customary thing to do.

Other nations may think a little bit differently and take risks of life into account.

The best thing for stupidity is to sue. But remember to grow your children in an American way: let them do whatever they want without severly reprimanding them. After all, you might go to jail after slaping butt of your child that does not want to listen and do the thing maliciously just to make you angry.

So don't put a preassure on your kid to think. What is gonna happen? Well maybe some day your kid will get sued if he/she "accidentally" hits a person. Not very likely, right?

Important thing is to rise your kids without "stress". So let them do whatever they want (no drugs or smoking though! ... they can enroll when they are 18 so army will teach them to kill, but absolutely no liquor or smoking by 21!)


Just one thing: don't woder why there is so many freaks on the streets in the US of A who might be unppredictable and perhaps might rape someone for fun.

I agree that everyone assumes a degree of risk on the slope. Accidents will happen, but there needs to be some deterrent to recklessness. Maciak is a little ott but there is a problem with parents using a hill as a kid dump, assuming, it is something like an amusement park with no responsility and no consequences. Ideally kids would have to do a short safety program in order to get a lift ticket. I don't think any kid reads the responsibility code volenterely or understands that at 40 mph, you have the potential to kill someone.

You should see the aircraft industry. A guy disregards the weather, flies into known icing and winds up in a beet field, and the attorneys convince the families there's blame to be laid and money to be made. Everyone is sued, from the manufacturer of the airframe, the engine, the company that made the oil filter, the mechanic that installed the oil filter, the instructor that gave the guy his sign-off a year before the accident, and on and on. It's cheaper to settle and so they do. No clue about the famed CA Governor and the status of any groping lawsuits. If so, he no doubt will have to retain his own counselor for that - I do not believe the tax payers will be liable for paying for his attorney, mostly because it happened prior to his time in office. Just wouldn't be prudent! For the most part, I don't believe they are "poor women," I believe they are just greedy!!

It's wrong, but what's even worse are all the child rapists, child porno nuts, and child abusers. Personally, I think that is more of a problem than groping. Because Ahnald is a big man on campus, they'll come out of the woodwork! If he was some average joe-engineer at some company, it wouldn't be a big deal & nooooo one would know! Yes, America has too many attorneys, but the good thing is that not all of us are into making this the most litigious country in the world! :p I also think there are too many chiropractors sucking off of workers' compensation by making people "chiro junkies." And, I also think there are too many gas stations, fast food restaurants, television stations, etc. But isn't American the land of opportunity? The land of plenty? The place where excess is king!?!?
